男女雇用機会均等法を考える

◆◇◆男女雇用機会均等法◆◇◆
元々は1972年に「勤労婦人福祉法」として施行されたが、女性差別撤廃条約批准のため、1985年に「雇用の分野における男女の均等な機会及び待遇の確保等女子労働者の福祉の増進に関する法律」として制定され、その際に「男女雇用機会均等法」の名称が生まれたものと思われます。その後、女性に対する労働上の差別をなくすために改正が重ねられました。又、平成18年６月２１日に公布された「雇用の分野における男女の均等な機会及び待遇の確保等に関する法律及び労働基準法の一部を改正する法律（平成１８年法律第８２号）」が、平成１９年４月１日から施行されます。

◆◇◆改正法のポイント◆◇◆
・男女雇用機会均等法
1　性別による差別禁止の範囲の拡大
（1）男性に対する差別も禁止されます。
　女性に対する差別の禁止が男女双方に対する差別の禁止に拡大され、男性も均等法に基づく調停など個別紛争の解決援助が利用できるようになります。
（2）禁止される差別が追加、明確化されます。
・ 募集・採用、配置・昇進・教育訓練、福利厚生、定年・解雇に加えて降格、職種変更、パートへの変更などの雇用形態の変更、退職勧奨、雇止めについても、性別を理由とした差別は禁止されます。
・ 配置については、同じ役職や部門への配置であっても権限や業務配分に差がある場合異なった配置となり、性別を理由とした差別は禁止されます。
（3）間接差別が禁止されます 。
　外見上は性中立的な要件でも、省令で定める一定の要件については、業務遂行上の必要などの合理性がない場合には間接差別として禁止されます。
2　妊娠・出産等を理由とする不利益取扱いの禁止
（1）妊娠・出産・産前産後休業の取得を理由とする解雇に加え、省令で定める理由による解雇その他不利益取扱いも禁止されます。
（2）妊娠中や産後1年以内に解雇された場合、事業主が妊娠・出産・産前産後休業の取得その他の省令で定める理由による解雇でないことを証明しない限り、解雇は無効となります。
3　セクシュアルハラスメント対策
　職場でのセクシュアルハラスメント対策については、これまでも配慮が求められてきたところですが、男性に対するセクシュアルハラスメントも含めた対策を講じることが義務となります。
　
対策が講じられず是正指導にも応じない場合企業名公表の対象となるとともに、紛争が生じた場合、男女とも調停など個別紛争解決援助の申出を行うことができるようになります。
（注）この規定は派遣先の事業主にも適用されます。
4　母性健康管理措置
　事業主は、妊産婦が保健指導又は健康診査を受けるために必要な時間を確保するとともに、妊産婦が保健指導又は健康診査に基づく指導事項を守ることができるようにするための措置（時差通勤、休憩回数の増加、勤務時間の短縮、休業等）を講ずることが義務となっています。
　こうした措置が講じられず是正指導にも応じない場合企業名公表の対象となるとともに、紛争が生じた場合、調停など個別紛争解決援助の申出を行うことができるようになります。
5　ポジティブ・アクションの推進
　ポジティブ･アクション（男女間の格差解消のための積極的取組）に取り組む事業主が実施状況を公開するに当たり、国の援助を受けることができます。
6　過料の創設
　厚生労働大臣（都道府県労働局長）が事業主に対し、男女均等取扱いなど均等法に関する事項について報告を求めたにもかかわらず、事業主が報告をしない、又は虚偽の報告をした場合は過料に処せられます。

・労働基準法
女性の坑内労働の規制緩和
　女性の坑内労働について、女性技術者が管理・監督業務を行えるように規制が緩和されます。

◆◇◆まとめ◆◇◆
　以上の点が大まかな改正点となっております、今回の改正において女性の差別を排除するだけではなく、全ての労働者間の差別を無くしていこうという意図がより鮮明なっているものと思われます。また、現行法では、セクシュアル・ハラスメントの現状に対応するには不十分であるとの意見がありましたが（図１・２参照）、今回の法改正にセクシュアル・ハラスメント関連の項目も加わり、可能性も見え始めています。今後、より実効性のあるものになっていくのではないかと思われます。
